Terms and Conditions
Our business goal is to provide excellent Information Technology services and assist your business in achieving success. i5 Networks, Inc. and its associates provide their services to you subject to the following conditions. Please read this term carefully as the conditions constitute basic terms in which i5 Networks, Inc. reserves the right to apply to any business that agrees in using its products and services.
Services: All services provided by i5 Networks, Inc. and its associates are guaranteed and non-refundable.
Services Hours: Normal service hours are Mondays-Fridays from 9:00 am to 6:00 pm excluding national holidays. Services performed outside normal business hours will be charged at one and one-half times the normal hourly rate.
Licenses: i5 Networks, Inc. reserves the right to deny service to businesses that do not comply with legal acquisitions of hardware and software licensing. All items must be properly licensed in order to be serviced.
Site Access: The customer will be responsible for providing proper access to the facilities and to the equipment/software in need of service.
Credentials: The customer will be responsible for providing necessary credentials to be confidentially used by i5 Networks, Inc. associates during remote or on-site support calls.
Service Rate: Services provided by i5 Networks, Inc. will be charged at a flat rate on an hourly basis. i5 Networks, Inc. reserves the right to change Services Rates at any time without public notice and with a 30 days notice to current customers. Services performed outside normal business hours will be charged at one and one-half times the normal hourly rate.
Labor Estimate: Services are estimated hourly on a time and material basis. Hours are billed on incremental of 15 minutes.
Service Fee: On-site or Remote service requests will be subject to a minimum of one-hour Service Rate. Service Fee for on-site services applies to locations within Greater Houston, Texas. Any on-site service request outside of this boundary may be subject to an additional charge per case basis. i5 Networks, Inc. reserves the right to change the Service Fee rate at any time without public notice and with a 30 days notice to current customers.
Parking and Expenses: The customer will be responsible for reimbursing i5 Networks, Inc. for occurred on-site visit parking charges, and may provide a parking validation card to the IT Consultant servicing the premise.
Taxes & Fees: Texas Sales Tax of 8.25% will be applied to all invoices for all hardware, software, and services. A fee of $35 will be added to any returned payment.
Payment Terms: Payments are due immediately after services are completed unless otherwise negotiated with the customer in advance. i5 Networks, Inc. reserves the right to request a prepaid block of hours for certain types of services and/or locations, or 50% advance payment for all projects and relocation services.
Collections: i5 Networks, Inc. reserves the right to receive payment for services provided in a timely manner, and we will work all efforts to collect any debts. A late fee of 1.5% of the total own amount will be added to customers’ invoices every 30 days for a period of 90 days. If payment is not received within 90 days, customers’ invoices will be turned over to a collection agency, generating an invoice amount increase of collection agency charge plus a 35% charge for the collection.
Confidentiality: i5 Networks, Inc., and Customers including employees, agents, and contractors, shall maintain the confidentiality of all trade secrets and information that is the exclusive property of the respective parties. Confidential information shall not be sold, licensed, published, distributed, disclosed, or otherwise to third parties except to such third parties that i5 Networks, Inc., at the best judgment, considers necessary to effectively provide services, software, or hardware requested by each Customer.
Limitation of Liability: Neither i5 Networks, Inc. nor its associates or sub-contractors shall be liable for any loss or damage to software, hardware, data, property, injury, or death of the customer’s agents, employees, or other customers arising in the connection with services provided by i5 Networks, Inc. and its associates or sub-contractors unless such loss, damage, injury, or death results solely from the neglecting or willful misconduct of i5 Networks, Inc. and its associates or sub-contractors. In no event shall i5 Networks, Inc. be liable for any general, special, incidental, or consequential damages for loss, or expenses, directly or indirectly arising from customers’ other direct third party services' inability to use or service customers’ property, either separately or in combination with any other or from any other cause.
